Common questions asked concerning the Danske Bank Solicitor Panel
from members of the public
Is the fact that my conveyancer is not isted on the Danske Bank Conveyancing panel that there is a problem with the standard of the firm’s conveyancing?
It would not be wise to jump to that conclusion. There are all sorts of perfectly reasonable explanations. A recent report by the solicitors regulator indicated 76% of law firms surveyed had been removed from at least one lender panel. The most common reasons for removal are: (1) lack of transactions (2) the lawyer is a sole practitioner (3) as part of the HSBC panel reduction (4) regulatory contact by SRA (5) accidental removal. If you are concerned you should simply call the firm and ask them why they are no longer on the approved list for Danske Bank.
We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. This was going to be dealt with as part of the conveyancing process but my mortgage company Danske Bank will not agree to this. Why was Danske Bank even consulted?
Your lawyer being on the Danske Bank conveyancing panel is duty bound to inform Danske Bank of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to Danske Bank then they would have to discontinue acting for you and Danske Bank.
I have been Googling for competitive conveyancing fees. Can I be confident that all the firms that are identified on your site are on the Danske Bank conveyancing panel?
The solicitor and licensed conveyancing practices listed on our site have assured us via an online form that they are on the Danske Bank panel and agreed to advise us to take down their listing in the event of removal off of the Danske Bank panel. To date we have not been informed by either a bank or a member of the public that the data about a specific firm being on the Danske Bank conveyancing panel is not accurate.
I am trying to get my ex-husband taken off the mortgage deeds. Can Danske Bank really tell me which solicitor I can or can not instruct?
You can use any solicitor you like but Danske Bank then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Danske Bank solicitors panel
Do conveyancing lawyers on the Danske Bank conveyancing panel work on a no move no charge basis?
In the main there are no requirements by lenders for their firms to operate on a no-sale-no-fee basis. There a small number of lenders who operate a very restricted conveyancing panel managed by a third party company (often termed in the industry as a ‘gatekeeper’). That third party may impose certain conditions such as non-sale-no fee on the panel firms. If you require this as a condition of your conveyancing then you should check with the conveyancing firm that this is part of their package
Do most banks operate their own panel of solicitors?
Many lenders do operate a restricted conveyancing panel but a lot of lenders allow any solicitors to join their panel so long as they meet their criteria. Each lender sets their own criteria. For example the Danske Bank conveyancing panel requirements are different to Danske Bank’s conveyancing panel requirements.
We have agreed to purchase a house. One unusual aspect is that the roof has a solar panel. Danske Bank have issued a mortgage offer so presumably this is not a concern to them. Why is my solicitor raising questions about the panel?
As your lender is Danske Bank your lawyer must to check the Danske Bank conveyancing instructions contained in the Part of CML Handbook for Danske Bank . The CML Handbook contains minimum requirements for solar panel roof-space leases, and solicitors are required to report to Danske Bank where a lease does not meet these requirements. The requirements relate to the installation of panels on properties in England and Wales. Requirements for Scotland are due in the near future.
